The 6-Month NJ Building Code Grace Period (Aug 2026 – Feb 2027): What It Means For You
When New Jersey adopts a revised Uniform Construction Code (UCC), an eligible complete permit application may have a limited transition option under N.J.A.C. 5:23-1.6. This is not an automatic entitlement: required prior approvals, the operative adoption date, and enforcing-agency procedures matter.
The Current Transition Timeline
- State Adoption Date: August 17, 2026.
- Potential Six-Month Cutoff: February 17, 2027, subject to the applicable rule and eligibility conditions.
How to Use the Transition Safely
Ask the enforcing agency whether your complete application, including required prior approvals, qualifies for review under the immediately preceding code during the applicable six-month period. Confirm the operative date and document the selected code edition before submitting.
Do not mix editions: Follow the agency's instructions for the applicable code edition across the project and obtain written clarification before relying on a transition option.
